Dutch journalist facing prison term in Panama for criminal libel

International journalism groups call for the release of Okke Ornstein, who is facing 20 months in jail over articles published on his blog


Okke Ornstein writes a blog about corruption.

A Dutch journalist, Okke Ornstein, is being held in jail in Panama after being arrested last Tuesday (15 November) on a charge of criminal libel.

He is facing a 20-month prison sentence over articles published on his blog about the business practices of a Canadian who lives in Panama City, Monte Friesner.

The Dutch Journalists Association (NVJ) has called for Ornstein’s release, arguing that the charge is baseless.

Its secretary-general, Thomas Bruning, said the prison sentence “is against the fundamental principles of freedom of speech and the freedom of expression, principles that are acknowledged as fundamental rights worldwide.”

His call is backed by the International and European Federations of Journalists (IFJ and EFJ). IFJ’s president, Philippe Leruth, said: “Journalists should be able to investigate freely. The messenger is being punished [for his message].

“This prison sentence sends a signal that critical journalism on fraud and corruption is not possible in Panama. Ornstein is being punished in a way that does not comply with the principles of a democratic justice system.”

According to Ornstein’s lawyer, Channa Samkalden, Ornstein did not get due process during the criminal proceedings in Panama following a complaint from Freisner.

NVJ is working with the Dutch foreign ministry and the Dutch embassy in Panama to secure Ornstein’s release.

Ornstein, who works for Dutch broadcasters and Al-Jazeera, often writes about corruption and fraud cases on his bananamarerepublic blog (which is currently closed).

His broadcasting work has been nominated for awards, such as the Prix Europa radio prize in 2013 and the Tegel prize in 2015.

In the former instance, his radio documentary about the environmental consequences of a hydroelectric dam in Panama funded by a Dutch bank prompted questions in the Dutch parliament.

Panama Papers: Europol links 3,500 names to suspected criminals

Law enforcement agency analysis uncovers probable matches connected to terrorism, money laundering and organised crime

Almost 3,500 individuals and companies in the Panama Papers are probable matches for suspected criminals including terrorists, cybercriminals and cigarette smugglers, according to a document seen by the Guardian.

The analysis, which was carried out by Europol, the EU’s law enforcement agency, sheds more light on the breadth of criminal behaviour facilitated by tax havens around the world.

“The main point here is that we can link companies from the Panama Papers leaks not only with economic crimes, like money laundering or VAT carousels, but also with terrorism and Russian organised crime groups,” Simon Riondet, head of financial intelligence at Europol, told a committee of MEPs.

The Panama Papers, leaked files from the offshore services company Mossack Fonseca, revealed that hundreds of the world’s wealthiest and most powerful individuals had used offshore companies to hide their riches.

While the use of offshore structures is legal, critics have long alleged that they can also be used to facilitate improper or unlawful behaviour.

The memo was prepared for a European parliamentary committee investigating how the offshore world can be used to facilitate tax abuse and international crime.

According to the memo, Europol compared a publicly available version of the Panama Papers published by the International Consortium of Investigative Journalists with its own databases of individuals and companies suspected of criminal involvement and identified 3,469 probable matches .

It matched 1,722 names in the Panama Papers with entities that had been reported by EU member states as having been involved in potential money-laundering transactions. The majority of matches originated from the UK, although the memo cautioned that this was probably due to the country’s status as Europe’s pre-eminent financial centre.

Of the rest, among others, a further 516 of the matches were connected to eastern European organised criminal gangs, 388 were connected to VAT fraud operations, and 260 to cigarette smuggling operations. It said 116 of the names were connected to “Hydra” – a Europol codeword for Islamist terrorism, according to the document – while 99 related to “Cola”, or drug crime.

One of the “main schemes” identified by the Europol analysis of the Panama Papers involves the abuse of trusts – legal arrangements whereby the owner of an asset places it under the control of another individual or company – by criminals seeking to obscure their assets.

The document identifies “the use of corporate service providers by criminals to acquire large numbers of shell companies (including finding third parties for positions within the company) located in offshore/tax havens (usually under the form of holding companies or trusts)” as one such scheme.

That analysis stands in stark contrast with a 2013 letter by David Cameron to the then president of the European council, in which he argued for trusts to be excluded from new transparency measures that would affect offshore companies.

“As we clamp down on the misuse of companies, we must take care not to displace illicit activity elsewhere,” the then prime minister wrote, adding later in the letter: “It is clearly important we recognise the important differences between companies and trusts. This means that the solution for addressing the potential misuse of companies – such as a central public registries – may well not be appropriate generally.”

Separately to its analysis of the Panama Papers, the Europol briefing also suggests that Luxembourg, widely known as a major tax haven for multinational corporations, is also failing to tackle money-laundering offences.

“Reporting figures across the EU do not always appear to be commensurate with the activities of the regulated sector in particular jurisdictions: notably Cyprus and Malta and Luxembourg receive very few reports given the significance of these jurisdictions in offshore financial service and the online gambling industry,” the memo reads.

“Furthermore, the vast majority of reports filed with Luxembourg stem from a single electronic bank/payment service provider, in spite of the fact that other sectors, such as private banking and offshore financial services, offer significant scope for money-laundering activities and tax crimes.”

Europol declined to comment.

Separately, Giovanni Kessler, the director general of OLAF, the European anti-fraud office, told the MEPs his agency had opened four investigations into potential cases of fraud against the European Union “on the basis of an analysis of information related to the Panama Papers and of information obtained from other sources”.

Euroopan komissio: Suomi saa haudata hallintarekisterin – osakeomistuksia ei saisi salata edes ulkomaiden kautta

Suomella ei ole mitään pakkoa sallia omistusten piilottamista.

Suomi voi haudata hallintarekisterin lopullisesti, jos eduskunta niin haluaa. Samalla Suomi voi kieltää hallintarekisterin käytön eli suomalaisten osakeomistusten salaamisen myös ulkomailla.

Euroopan komissio katsoo näin vastauksissaan, jotka se on antanut Suomelle.

Vastaukset sai eduskunnan talousvaliokunnan puheenjohtaja Kaj Turunen (ps). Ne on kirjoittanut komission rahoitusvakauden, rahoituspalvelujen ja pääomamarkkinaunionin pääosasto.

Monet tahot ovat yrittäneet aiemmin turhaan saada komissiolta kannanottoa asiaan. Helsingin Sanomat julkaisee komission antaman ensimmäisen kannanoton sekä vastaukset lisäkysymyksiin. Hallintarekisterin käytön kieltäneen Norjan sekä Suomen valtiovarainministeriön kannat ovat puolestaan täällä.

Komission kanta on merkittävä, sillä hallintarekisterin käsittely eduskunnan talousvaliokunnassa on yhä kesken. Valiokunnan kokoomusjäsenet ovat ajaneet tulkintaa, jonka mukaan Suomen on pakko sallia kansalaistensa osakeomistusten hallintarekisteröinti ulkomailla, jos suomalaisyhtiö listautuu ulkomaisessa arvopaperikeskuksessa.

Kokoomusedustajat ovat saaneet voimakasta tukea valtiovarainministeriöstä, joka on ajanut hallintarekisteriä vuosikausia.

”Suomen ei tarvitse eikä kannata muuttaa osakeyhtiölakia niin, että omistukset voitaisiin piilottaa hallintarekisteriin ulkomaille”, talousvaliokunnan puheenjohtaja Kaj Turunen sanoo.

Hänen mukaansa komission vastaus on täysin linjassa hänen näkemyksensä kanssa: kun yhtiö laskee liikkeeseen osakkeita ulkomailla, soveltuu yhtiön osakkeisiin edelleen yhtiön kotivaltion osakeyhtiösääntely.

”Johdanto-osan kappaleessa (42) vahvistetaan, että asetus kohtelee suoran ja epäsuoran omistuksen malleja tasavertaisesti”, komission vastauksessa katsotaan. Komission mukaan siis suomalaisen pörssiyhtiön kohdalla sovelletaan kansallista lainsäädäntöä siitä, onko hallintarekisteröinti mahdollista vai ei.

On siis täysin suomalaisten poliittisen päätöksen varassa, halutaanko suomalaisille antaa oikeus piilottaa pörssiosakkeita ulkomaisen arvopaperikeskuksen kautta.

”En ole saanut kuluneen vuoden aikana selville, kokoomuksen ja keskustan motiivia ajaa omistuksien salaamisen mahdollisuutta. Ihmettelen tästä suuresti”, Turunen sanoo.

Hallintarekisteri nousi jälleen esille perjantaina, kun valiokunnan jäsenet Arto Pirttilahti (kesk) ja Harri Jaskari (kok) tulivat perjantaina julkisuuteen hallintarekisteriasiassa. He katsoivat Talouselämän haastattelussa, että EU:n komissio ei ole ottanut selvää kantaa asiaan.

Jaskari sanoo lehdessä, että "Sieltä [komissio] sanotaan ainoastaan, että tässä on asetus, tulkitkaa siitä".

Turunen ihmettelee, että Pirttilahti ja Jaskari ”antoivat vähintäänkin virheellistä tietoa asiasta”.

Pirttilahti ja Jaskari sanovat haastattelussa, että valtiovarainministeriö on valmistellut lähdeveron muuttamista. Se olisi ikään kuin porkkana, jolla perussuomalaiset saataisiin hallituksen esityksen taakse.

Jos pörssiyritys ei pysty kertomaan omistajiaan, siltä perittäisiin korotettua lähdeveroa osingoista.

Turusen mukaan ehdotus ei riitä perussuomalaisille.

”Se ei purisi millään tavalla myyntivoittoihin ja ehdotettu lähdevero olisi 30 prosenttia. Nykyisin pääomaverokin on suurempi eli 34 prosenttia yli 30 000 eron pääomatulosta”, Turunen ihmettelee.

Komission vastausten lisäksi Turunen on hankkinut Norjan tulkinnan EU:n arvopaperiasetuksesta. Norjan lain mukaan norjalaiset voivat omistaa pörssiosakkeita vain suoraan eli julkisesti. Hallintarekisteröinti on siis käytännössä kielletty norjalaisilta.

Norjalaisten vastauksen mukaan EU:n asetus ei estä sitä, että maa on kirjannut kiellon hallintarekisteröinnistä omaan osakeyhtiölakiinsa. Turusen mukaan myös Suomi voi tehdä näin.

Norjan vastauksen ohessa on Suomen valtiovarainministeriön kanta. Sen mukaan norjalaisten kanta ei vaikuta Suomen valtiovarainministeriön kantaan, jonka mukaan Suomi ei voi kieltää kansalaisiaan hallintarekisteröimästä ulkomailla.

Myös komission vastaus muistuttaa, että ainoastaan Euroopan Unionin tuomioistuin voi antaa sitovan tulkinnan eurooppaoikeudesta.

”Komissio ei voi puuttua Suomen lainsäädäntöprosessiin eikä antaa ennakkopäätöksiä. Komissio ei myöskään vaadi meitä hyväksymään omistuksien piilottamismahdollisuutta hallintarekisteriin suomalaisille, kun sijoitetaan suomalaisiin yrityksiin ulkomailla”, Turunen sanoo.

Turunen muistuttaa, että Suomen ei kannata sallia hallintarekisteröintiä lainmuutoksella senkään vuoksi, että Suomen neuvottelema poikkeussopimus suoran omistuksen säilyttämisestä kotimaassa ei ehkä enää olisi voimassa.

”Jos Suomi sallii hallintarekisteröinnin ulkomaiden kautta, se vaikeuttaa sisäpiirinkauppojen ja muiden talousrikosten selvittämistä sekä vähentää verotuksen varmuutta ja oikeudenmukaisuutta”, Turunen sanoo.

Jean-Claude Juncker blocked EU curbs on tax avoidance, cables show

Leaked papers reveal that as Luxembourg’s PM, the European commission president obstructed the bloc’s tax reforms efforts

The president of the European commission, Jean-Claude Juncker, spent years in his previous role as Luxembourg’s prime minister secretly blocking EU efforts to tackle tax avoidance by multinational corporations, leaked documents reveal.

Years of confidential German diplomatic cables provide a candid account of Luxembourg’s obstructive manoeuvres inside one of Brussels’ most secretive committees.

The code of conduct group on business taxation was set up almost 19 years ago to stop member states being played off against one another by increasingly powerful multinational businesses, eager to shift profits across borders and avoid tax.

Little has been known until now about the workings of the committee, which has been meeting since 1998, after member states agreed a code of conduct on tax policies and pledged not to engage in “harmful competition” with one another.

The leaked cables, however, reveal how a small handful of countries have used their seats on the committee to frustrate concerted EU action and protect their own controversial tax regimes.

Efforts by a majority of member states to curb aggressive tax planning and to rein in predatory tax policies were regularly delayed, diluted or derailed by the actions of a few of the EU’s smallest members, frequently led by Luxembourg.

The leaked papers, shared with the Guardian and the International Consortium of Investigative Journalists by the German radio group NDR, are highly embarrassing for Juncker, who served as Luxembourg’s prime minister from 1995 until the end of 2013. During that period he also acted as finance and treasury minister, taking a close interest in tax policy.

Despite having a population of just 560,000, Luxembourg was able to resist widely-supported EU tax reforms, its dissenting voice often only backed by that of the Netherlands.

Among proposals popular in the code of conduct committee, but opposed by Luxembourg, were:

• Plans for tax authorities in each member state to subject their dealings with multinational businesses to peer review

• An investigation into cross-border tax avoidance strategies, known as “hybrid mismatches”, often used by multinationals to conjure up artificial tax savings

• Improved information-sharing between member states on tax deals granted to multinationals in private

A spokesperson for Luxembourg’s finance ministry refused to comment on positions previous government’s have taken in private EU discussions.

“We have no knowledge of the communications you claim to have, and whether they are genuine, and therefore cannot comment on them,” he said.

“In recent years Luxembourg has been at the forefront of the global trend towards greater transparency in tax matters and the fight against harmful tax competition.”

The Guardian also spoke to another former member of the code of conduct committee who did not want to be named, but corroborated claims in the leaked cables that Luxembourg was regularly among those looking to frustrate EU efforts to tackle tax avoidance.

The source believes the committee is no longer fit for purpose. They said it was unable to achieve much because it was governed by unanimity. “Each country is ready to block any agreement. Moreover, each country stands ready to bargain its position on tax against any other topic at stake in the EU.”

Some tax experts the Guardian contacted confirmed that Luxembourg had begun to move away from certain aggressive tax policies under current prime minister, Xavier Bettel.

The leaked cables, however, suggest the country has remained resistant to other changes. Earlier this year, it fiercely opposed efforts supported by many countries to strengthen and expand the code of conduct committee’s work.

Luxembourg particularly objected to a relaxation in the committee’s own rules on decision making, insisting there was no need to abandon the unanimity requirement.

France, Germany and Sweden argued unsuccessfully that removing unanimity had become essential to the committee’s effectiveness.

Luxembourg also opposed plans to identify member states that were standing in the way of reforms more clearly. One leaked cable noted: “It has become abundantly clear once again that a majority [of members states] are not interested in real reforrm.

“In particular, Luxembourg representatives said they would fundamentally object to any proposal to publish arguments made by Luxembourg in the committee.”

A later cable read: “It is impressive to see how some member states present themselves outwardly as proponents of [international tax reforms] and at the same time to watch how they actually behave in EU discussions, protected by confidentiality.”

The Guardian contacted Juncker’s office for comment, but a spokesperson said it was not for the European commission to respond to questions about negotiating positions Luxembourg had taken, or on the country’s past tax policies.

Damaging revelations

Jean-Claude Juncker’s record as Luxembourg’s prime minister has cast an enduring shadow over his presidency of the European commission.

On paper, his marathon 18-year stint at the helm of the EU’s second smallest member state might be hailed a triumph.

He recast the fading steel-based economy into a booming hub for international business, and when he departed in 2013 Luxembourg had been transformed into one of the richest countries in the world per capita.

Hundreds of the multinational corporations rushed to channel international profits through subsidiaries in the country, among them McDonald’s, Fiat, Amazon, Shire Pharmaceuticals and Skype.

The secret to this success was exposed in 2014 when the Luxleaks scandal revealed the controversial terms hidden within hundreds of private deals, known as “tax rulings”, that Luxembourg had handed out to multinational businesses behind closed doors.

The rulings effectively rubber-stamped complex tax structures global corporations use to access ultra-low tax rates, often less than 1%, for profits shifted to Luxembourg.

Juncker conceded the scandal had damaged his reputation. While not illegal, he admitted Luxembourg’s tax system was also “not always in line with fiscal fairness” and may have breached “ethical and moral standards”.

Since then, Juncker has made a point of supporting the competition commissioner, Margrethe Vestager, as she pursues high-profile investigations into specific tax rulings, including deals Luxembourg granted separately to McDonalds and to Amazon.

The investigations examine whether the private deals for the two businesses were so generous that they amount to illegal state aid from Juncker’s Luxembourg.

Juncker has also campaigned hard for greater tax cooperation among member states in the battle against international businesses that avoid tax. The latest leaked cables, however, raise further questions about whether he is the right person to champion such reforms.

Panama Papers investigation wins Pulitzer prize

Guardian and other media organisations collaborated on series of stories exposing offshore secrets of rich and famous

The Panama Papers investigation into the offshore secrets of the rich and famous has been awarded a prestigious Pulitzer prize.

The prize was given to the Washington-based International Consortium of Investigative Journalists (ICIJ), together with two US titles, McClatchy and the Miami Herald.

The judges cited a series of stories from the Panama Papers and the “collaboration of more than 300 reporters on six continents to expose the hidden infrastructure and global scale of offshore tax havens”.

The consortium included Germany’s Süddeutsche Zeitung – which received 11.5m documents from a whistleblower – the Guardian, the BBC and about 100 other international media organisations. The project is believed to have been the largest journalistic cooperation ever.

The investigation was originally entered into the international reporting category where it was a shortlisted finalist. It was moved to the 2016 explanatory reporting category, which it won.

The German reporters who received the leak, Bastian Obermayer and Frederik Obermaier, paid tribute to “John Doe”, their anonymous source. He – or she – provided internal files and emails from the Panamanian law firm Mossack Fonseca, which specialises in setting up opaque offshore companies...

Pakistanin korkein oikeus pakottaa pääministeri Nawaz Sharifin eroamaan – Panaman paperit todistivat korruptiosta

Sharif on Pakistanin politiikan voimahahmo, joka pakotettiin jo kolmannen kerran urallaan eroamaan ennen kautensa päättymistä.

PAKISTANIN pääministeri Nawaz Sharif joutuu eroamaan virastaan korruptiosyytösten vuoksi. Maan korkein oikeus totesi perjantaina, että Sharif on kelvoton virkaansa, uutistoimisto AFP kertoi.

”Sharif ei ole kelvollinen hoitamaan kansanedustajan tehtävää, joten hän ei voi toimia myöskään pääministerin virassa”, tuomari Ejaz Afzal Khan julisti täyteen ahdetussa oikeussalissa pääkaupungissa Islamabadissa.

Pakistanin muslimiliittoa edustanut Sharif on Pakistanin politiikan pitkäaikainen voimahahmo, joka valittiin ensimmäisen kerran pääministeriksi jo vuonna 1990.

Hänen kolmatta viisivuotiskauttaan olisi ollut vuosi jäljellä.

SHARIFIN korruptiosyytteet tulivat esiin viime vuonna niin sanottujen Panaman paperien myötä.

Kolme Sharifin lapsista, kaksi poikaa ja yksi tytär, omistivat tiedotusvälineille vuodettujen asiakirjojen mukaan Lontoossa kiinteistöjä, joihin heillä ei voinut olla varaa. Kiinteistöjen omistus oli piilotettu offshore-yhtiöiden kautta.

Sharifin lapset eivät ole kyenneet esittämään uskottavia selityksiä rahojensa alkuperästä. Heidän oikeudelle toimittamansa kuitit ja asiakirjat paljastuivat tekaistuiksi, sanomalehti The New York Times kertoo.

Sharif on kiistänyt syytökset ja sanonut ettei ole tehnyt mitään väärää.

JO KOLMATTA kautta pääministerinä olleen Sharifin kohtalo oli perjantaina epäselvä, mutta maan korruptioviranomaiset kehottavat nostamaan Sharifia vastaan myös rikossyytteen.

Lain mukaan Sharifin puolueen Pakistanin muslimiliiton on valittava maalle virkaa toimittava pääministeri. Seuraavat vaalit järjestettäneen kesällä 2018.

Korkein oikeus totesi perjantaina myös Pakistanin valtiovarainministerin ISHAQ DARIN olevan kelvoton hoitamaan virkaansa.

PAKISTANIN politiikassa oikeudenkäynnit, vankeustuomiot ja jopa salamurhat ovat tavallisia.

Politiikan myrskyisyydestä kertoo sekin, että kolminkertainen pääministeri Sharif ei kertaakaan päässyt kautensa loppuun asti.

Ensimmäisellä kaudella 1990–93 asevoimat pakottivat Sharifin eroamaan kesken kauden. Vuonna 1997 alkanut toinen kausi päättyi 1999, kun kenraali Pervez Musharrah syrjäytti Sharifin verettömässä vallankaappauksessa.

Seuraavana vuonna Sharif tuomittiin elinkautiseen vankeuteen Musharrafin vastaisesta salaliittoon kuulumisesta. Tuomio muutettiin elinikäiseksi karkotukseksi Saudi-Arabiaan.

Sharif kuitenkin onnistui tekemään paluun vuonna 2007, ja kahden vuoden kuluttua Pakistanin korkein oikeus kumosi kaikki Sharifin tuomiot, karkotukset ja virkakiellot.

SHARIFIN pitkäaikainen arkkivastustaja, niin ikään vankilassa istunut entinen krikettitähti Imran Khan voimistunee skandaalin seurauksena.

Khanin keskustapopulistisen Tehreek-e-Insaf-puolueen uskotaan nyt olevan hyvissä asemissa seuraavia vaaleja ajatellen. Viime vaaleissa 2013 Khan hävisi Sharifille selvästi.

Malta car bomb kills Panama Papers journalist

The journalist who led the Panama Papers investigation into corruption in Malta was killed on Monday in a car bomb near her home.

Daphne Caruana Galizia died on Monday afternoon when her car, a Peugeot 108, was destroyed by a powerful explosive device which blew the car into several pieces and threw the debris into a nearby field.

A blogger whose posts often attracted more readers than the combined circulation of the country’s newspapers, Galizia was recently described by the Politico website as a “one-woman WikiLeaks”. Her blogs were a thorn in the side of both the establishment and underworld figures that hold sway in Europe’s smallest member state.

Her most recent revelations pointed the finger at Malta’s prime minister, Joseph Muscat, and two of his closest aides, connecting offshore companies linked to the three men with the sale of Maltese passports and payments from the government of Azerbaijan.

No group or individual has come forward to claim responsibility for the attack.

Malta’s president, Marie-Louise Coleiro Preca, called for calm. “In these moments, when the country is shocked by such a vicious attack, I call on everyone to measure their words, to not pass judgment and to show solidarity,” she said.


Daphne Caruana Galizia, who claimed to have no political affiliations, set her sights on a wide range of targets, from banks facilitating money laundering to links between Malta’s online gaming industry and the Mafia.

After a fraught general election this summer, political commentators had been fearing a return to the political violence that scarred Malta during the 1980s.

In a statement, Muscat condemned the “barbaric attack”, saying he had asked police to reach out to other countries’ security services for help identifying the perpetrators.

“Everyone knows Ms Caruana Galizia was a harsh critic of mine,” Muscat at a hastily convened press conference, “both politically and personally, but nobody can justify this barbaric act in any way”.

The Nationalist party leader, Adrian Delia – himself the subject of negative stories by Galizia – claimed the killing was linked to her reporting. “A political murder took place today,” Delia said in a statement. “What happened today is not an ordinary killing. It is a consequence of the total collapse of the rule of law which has been going on for the past four years.”

According to local media reports, Galizia filed a police report 15 days ago to say that she had been receiving death threats.

The journalist posted her final blog on her Running Commentary website at 2:35pm on Monday, and the explosion, which occurred near her home, was reported to police just after 3pm. Officers said her body had not yet been identified. According to sources, one of her sons heard the blast from their home and rushed out to the scene.

Galizia, who claimed to have no political affiliations, set her sights on a wide range of targets, from banks facilitating money laundering to links between Malta’s online gaming industry and the Mafia.

Over the last two years, her reporting had largely focused on revelations from the Panama Papers, a cache of 11.5m documents leaked from the internal database of the world’s fourth largest offshore law firm, Mossack Fonseca.

The data was obtained by the German newspaper Süddeutsche Zeitung and shared with media partners around the world, including the Guardian, by the International Consortium of Investigative Journalists (ICIJ) in Washington.

Galizia’s son, Matthew Caruana Galizia, is a journalist and programmer who works for the ICIJ.

Earlier this year, during Malta’s presidency of the European Union, her revelations caused major concern in Brussels.

MEPs openly called for Muscat’s departure amid a growing scandal involving his wife, a Panamanian shell company and alleged payments from the president of Azerbaijan’s daughter.

Muscat, who has been premier since 2013, went to the polls a year early after his wife was implicated in the scandal. He has always denied any wrongdoing and promised to quit if any evidence emerges of his family having secret offshore bank accounts used to stash kickbacks – as Caruana Galizia had alleged.

Responding to news of the attack, the German MEP Sven Giegold, a leading figure in the parliament’s Panama Papers inquiry, said he was “shocked and saddened”.

“It is too early to know the cause of the explosion but we expect to see a thorough investigation,” said Giegold. “Such incidents bring to mind Putin’s Russia, not the European Union. There can be absolutely no tolerance for violence against the press and violations of the freedom of expression in the European Union.”

Opposition politicians claim there has been a collapse in the rule of law in Malta since Muscat returned Malta’s Labour party to power in 2013 following a long period in opposition. Four police commissioners have resigned under his leadership. The fifth, Lawrence Cutajar, took up his post in August 2016.

There have been several car bomb killings in Malta during recent years. While the perpetrators have not been identified, the violence is thought to have been linked to disputes between criminal gangs. None are thought to have been politically motivated.

Galizia was 53 and leaves a husband and three sons.

Autopommi syöksi Maltan epävarmuuteen – Murhatun tutkivan journalistin Daphne Caruana Galizian poika hyökkää pääministeriä vastaan: ”Täyttänyt poliisin ja oikeusistuimet roistoilla”

Viimeisen kahden vuoden aikana Maltalla on tehty kuusi autopommi-iskua, jotka kaikki ovat yhä selvittämättä.

AUTOPOMMI-ISKUSSA kuoleminen ei ole niin tavaton kuolinsyy piskuisessa Maltan saarivaltiossa kuin äkkiseltään voisi kuvitella. Viimeksi kuluneen kahden vuoden aikana on tehty kuusi iskua, jotka ovat kaikki yhä selvittämättä.

Murhat ja niiden yritykset kuitataan EU-maa Maltalla yleensä järjestäytyneen rikollisuuden välienselvittelyiksi, mutta maanantai-iltapäivänä kaikki muuttui. Maan lähihistorian puhutuimman henkilön, toimittaja-bloggari Daphne Caruana Galizian kuolema autopommin räjähdettyä järisyttää koko maata.

CARUANA Galizia oli vuosia piikki Maltan valtaapitävien lihassa. Hän linkitti pääministeri Joseph Muscatin vaimon ja muuta lähipiiriä Panaman veroparatiisiyhtiöihin. Paljastusten vuoksi Maltalla käytiin kesäkuussa parlamenttivaalit, jotka Muscatin johtama työväenpuolue monien yllätykseksi voitti.

Caruana Galizia arvosteli myös Muscatin läheisiä suhteita poliisiylijohtoon ja oikeusviranomaisiin. Caruana Galizian pojat allekirjoittivat heti murhan jälkeen vetoomuksen, jossa he vaativat korkeimman oikeusviranomaisen Consuelo Scerri Herreran sulkemista rikostutkinnan ulkopuolelle. Näin tapahtui.

Oppositiossa oleva konservatiivipuolue ja sitä lähellä oleva lehdistö syyttävät rivien välissä maan pääministeriä poliittisesta murhasta. Laajalevikkisin sanomalehti Times of Malta kutsuu pääkirjoituksessaan murhaa yritykseksi sulkea suut medioilta ja vaatii, että tekijöiden lisäksi on saatava vastuuseen myös teon tilaajat.

PÄÄMINISTERI Muscat on vakuuttanut, että kaikki mahdollinen tehdään syyllisten löytämiseksi. Virka-apua on hallituslähteiden mukaan pyydetty niin Yhdysvalloista liittovaltion poliisilta FBI:lta kuin EU:n poliisiviranomaiselta Europolilta.

Maanantain autopommi ei ollut ensimmäinen kerta, kun Daphne Caruana Galizian kimppuun käytiin hänen uinuvassa kotikylässään Bidnijassa. Jo vuonna 2006 Caruna Galizian taloon tehtiin öinen murhapolttoyritys. Tekijöitä ei saatu selville.

Erilaiset uhkaukset olivat Caruana Galizialle arkipäivää. Hän ajoi vuokra-autoilla välttääkseen mahdolliset iskut, mutta sekään ei lopulta riittänyt.

TIISTAINA kolmensadan asukkaan Bidnijassa oli tavallistakin hiljaisempaa. Pittoreskin kylän ainoaa kauppaa pitävä Mark Jarrugia suostui haastateltavaksi vain, koska artikkeli julkaistaan kaukana Maltalta.

”Tämän murhan takana olevilla ihmisillä ei ole sielua eikä sydäntä. He ovat alhaisempia kuin eläimet.”

Daphne Caruana Galizia kävi Jarrugian kaupassa silloin tällöin, muttei ollut vakioasiakas.

”Pidin joistakin hänen bloggauksisaan, joistain en. Mutta hänelle kuului oikeus julkaista ne kaikki.”

NUORET maanviljelijät Catherine ja Thomas Buhagiar eivät usko, että Caruana Galizian murha koskaan selviää.

”Maltan poliisi, no, niin.”

Buhagiarin pariskunta ja kyläkauppias Jarrugia vaihtoivat tietäväisiä katseita. Valokuviin he eivät suostuneet, kuten ei kukaan mukaan bidnijalainen.

”Kauppaa saa kuvata ulkoapäin, mutta ihmisiä täällä Bidnijassa ei”, tuumi Jarrugia.

BIDNIJALAISTEN elämää vaikeutti tiistaina sekin, että kylään johtava pääväylä oli edelleen poikki, kun rikospaikan tekninen tutkinta jatkui.

Bidnijassa oli hiljaista, mutta kaupungeissa sanomalehtiä myyvien pikkukauppojen edustoilla riitti ruuhkaa. Bidnijan lähellä sijaitsevassa Mostassa miehet selailivat Times of Maltaa, jonka mustapohjainen etusivu huusi ”Black Monday”, musta maanantai.

”Jos tässä maassa nostat pääsi liian korkealle, se leikataan irti. Niin se on”, sanoi yksi miehistä. Hän ei halunnut nimeään mainittavan.

ILMAPIIRI Maltalla kiristyi tiistain mittaan, kun sosiaalisessa mediassa ja lehdistössä murhaa kommentoitiin yhä kovemmin sanoin.

”Tässä ollaan, mafiavaltiossa, jossa ihminen räjäytetään kappaleiksi, koska hän yrittää toteuttaa perusoikeuksiaan”, kirjoitti Daphne Caruana Galizian poika Matthew Facebook-seinälleen.

”Hän [pääministeri Muscat] on täyttänyt poliisin ja oikeusistuimet roistoilla”, jatkoi edesmenneen äitinsä tapaan journalistina työskentelevä Matthew Caruana Galizia.

Yksi murhaa tutkivista poliisietsivistä pidätettiin tiistaina tehtävistään, kun hän oli avoimesti iloinnut teosta sosiaalisessa mediassa ja nimitellyt kuollutta Caruana Galiziaa.

POLIITTINEN väkivalta ja hyökkäykset toimittajia kohtaan eivät ole vuonna 1964 itsenäistyneen ja vuonna 2004 Euroopan unioniin liittyneen Maltan historialle vieraita.

Lähimenneisyydessä Malta on kuitenkin tullut tunnetuksi turvallisena lomakohteena, ja turismi onkin 415 000 asukkaan maan pääelinkeino.
