Iranian police have shut down 547 restaurants and cafes in Tehran for not observing “Islamic principles”, the capital’s police chief said Saturday.

“The owners of restaurants and cafes in which Islamic principles were not observed were confronted, and during this operation 547 businesses were closed and 11 offenders arrested,” Hossein Rahimi said in statement on the policeforce website.

Fars news agency said the operation was carried out over the past 10 days.

The infractions included “unconventional advertising in cyberspace, playing illegal music and debauchery”, Fars reported.

“Observing Islamic principles is ... one of the police’s main missions and responsibilities,” the police chief said.

The head of Tehran’s guidance court, which deals with “cultural crimes and social and moral corruption”, called on Tehran citizens to report cases of “immoral behaviour” by texting a designated phone number.

“People would like to report those breaking the norms but they don’t know how ... We decided to accelerate dealing with instances of public immoral acts,” Mohammad Mehdi Hajmohammadi told the judiciary’s Mizan Online.

Citizens can report instances of those removing their “hijab in cars”, “hosting mixed dance parties” or posting “immoral content on Instagram”, he said.

Under the Islamic dress code of Iran, where alcohol is banned, women can only show their face, hands and feet in public, and they are supposed to wear modest colours.

In 2012, the government ordered cafes to install security cameras in order to monitor the behaviour of customers. Some owners chose to close their doors instead.

“As much as it pains us and as much as we will miss our friends and all of you who stood by our side in the past four years, we take comfort in knowing that we at least didn’t let Big Brother’s glass eyes scan and record our every step, minute and memory from dawn till dusk,” wrote the owners of the popular Cafe Prague in a Facebook post at the time.

A sessions court in Lahore sentenced a man to death in a three-year-old blasphemy case and fined him Rs200,000.

In 2016, police had filed a first information report against a man identified as Saleem under Section 295-C of the Pakistan Penal Code after he had uttered blasphemous remarks in a public place in the Lohari Gate area.

According to Deputy Prosecutor General Muhammad Amjad,12 witnesses had recorded testimonies against Saleem. Six of the testimonies had been recorded in court, while the other half were recorded via video link due to security concerns.

Half the trial had been conducted in court, and the other half via video link while the accused remained in Camp Jail for security purposes. Additional sessions judge Faizul Hassan read the verdict out to Saleem over video link.

Senior Islamic cleric issues fatwa against child marriage

Deputy grand imam of al-Azhar calls for marriage based on mutual consent with minimum age set at 18

One of the world’s most prestigious centres of Islamic learning has issued a fatwa against child marriage, saying marriage should be based on the consent of both parties and “particularly the young woman”.

The deputy grand imam of al-Azhar, considered by some Muslims to be the highest authority of Islamic jurisprudence, hammered out the document with his team and young activists at the first African summit on child marriage and female genital mutilation, which took place in Senegal this week.

If news of the fatwa’s existence can reach imams in countries with high rates of child marriage, activists hope that the practice can be stopped, as they could not deny al-Azhar’s authority.

“Marriage in Islam is based on the consent of both parties, particularly the young woman. Such consent requires the young woman to have reached the age of maturity and reason, so that her consent is validly given,” the fatwa read, adding that this age was 18, and quoting parts of the Qur’an and the hadiths of the prophet Muhammad to support it.

The summit was organised by Jaha Dukureh, a Gambian campaigner and the founder of Safe Hands for Girls, herself a survivor of child marriage and FGM, who drove a successful campaign to end FGM in her country.

Dukureh, who went to Egypt to talk to the al-Azhar clerics last year, described how towards the end of the summit she realised that the fatwa had not yet been issued and went to talk to the imam, Salah Abbas. She, the African Union youth envoy Aya Chebbi and the Syrian journalist Abdalaziz Alhamza worked with the Egyptian imams to turn their rough draft, scrawled on hotel notepaper, into a formal document.

“We sat there on the floor with them, writing the fatwa. They had to call Egypt to ensure that everything was in line. And then there was a back and forth about the languages, because in Arabic things can be translated different ways. To me, it was just amazing watching that process.”

Four in 10 young women in sub-Saharan Africa are married before their 18th birthday. Boys are affected too – according to recent UN data, roughly one in 30 worldwide were married as children, with the highest number in Central African Republic, where almost a third of boys and men were child grooms.

The problem is not limited to Africa – across the world, 12 million girls are married in childhood every year. In Iraq in 2017, parliamentarians drafted a law that would allow children as young as nine to marry, based on the idea that the prophet Muhammad married his wife Aisha when she was just nine years old. The prime minister blocked the bill last year, but there are fears it will be reintroduced.

“When you force a girl to get married, you’ve given someone the right to rape her over and over again,” said Dukureh, who was married at 15 and again at 17. “And every single day, every time she’s touched … you don’t forget. I don’t think you forget that. I don’t think you ever get over that.

“I don’t think we understand the depth of what this [fatwa] could potentially do, and especially in communities where people continue to use religion to justify millions of girls’ pain and suffering.”

Part of the target group is Dukureh’s own father, an influential imam in Gambia.

“If I go to my dad, and give him the same statement that al-Azhar did, he wouldn’t listen to me. But if the deputy grand imam of al-Azhar is here, yes,” Dukureh said.

Her father appeared in a Guardian documentary made about her fight to stop FGM. She convinced him not to allow his baby daughter to be cut – the first girl in their family not to go through FGM.

Child marriage was something he never discussed, though.

“We came to a point of agreement when it comes to FGM. We never had a resolution on child marriage. Even my brothers, they would always tell me, you know, you can talk about FGM all you want. But with child marriage, you can’t touch it because the prophet’s wife was nine when he married her. So don’t even go there.”

But Dukureh convinced her father to come to the summit. In his white robes, cap and sandals, he prayed throughout, and later said: “I cried so much, because I learned so much.”

As well as the fatwa, the activists, religious and traditional leaders, government ministers and religious officials came up with a declaration on Africans taking a lead to stop FGM and child marriage, which they are asking countries to sign up to. Many organisations aim to eliminate the practices by 2030.

Much of the funding for the summit, which cost roughly $1.2m (£946,000) and was supported by the World Bank and UN population fund, came from individuals and grassroots organisations.

Atheists in Malaysia should be “hunted down” as they violate the constitution, a government minister in the increasingly fundamentalist Muslim-majority nation has said.

Shahidan Kassim, who serves in the Prime Minister’s inner circle, called on Islamic scholars to re-educate non-believers.

Apostasy is not a federal crime in Malaysia, but critics say the country’s increasingly conservative trajectory is threatening religious freedoms.

“The [Federal Constitution] does not mention atheists. It goes against the Constitution and human rights,” Mr Kassim said during a press conference.

“I suggest that we hunt them down vehemently and we ask for help to identify these groups.”

The MP for Arau, a town in the far north of Malaysia close to the border with Thailand, said atheists were “misled” and claimed they “don’t want to be atheists but it happens because of the lack of religious education”.

Mr Kassim called on “all muftis [Muslim religious scholars]” to “return them to the faith”.

It comes as the Malaysian government ordered an investigation into an international atheist organisation that is operating in the country.
A photo of a meeting of the Kuala Lumpur chapter of Atheist Republic sparked uproar among some Muslims and lead to death threats against the group on social media.

Malaysia's deputy minister in charge of religious affairs, Asyraf Wajdi Dusuki, said on Monday he had instructed the Federal Territories Islamic Religious Department to investigate the Atheist Republic chapter to see if any Muslims were involved.

"We need to determine whether any Muslims attended the gathering, and whether they are involved in spreading such views, which can jeopardise the aqidah [faith] of Muslims," he told Reuters.

Ex-Muslims in the group would be sent for counselling, while attempts to spread atheist ideas could be prosecuted under existing laws, Asyraf said.
"We need to use the soft approach with (apostates). Perhaps they are ignorant of the true Islam, so we need to engage them and educate them on the right teachings," he said.

Atheist Republic's founder, Armin Navabi, said the group's gatherings caused no harm to the public and were not considered a threat in other countries.

"They [atheists] are treated like criminals. They are just hanging out and meeting other atheists. Who are they harming?!" he said in a post on his Facebook account.

Malaysian states, which have their own laws governing Islamic affairs, do not allow Muslims to formally renounce Islam, preferring instead to send them for counselling, or fining or jailing them.

The country's apostasy laws have left many former Muslims in legal limbo, as they are not allowed to register their new religious affiliations or legally marry non-Muslims.

In 2007, Lina Joy, a Malaysian convert to Christianity, lost a high-profile legal battle to have the word "Islam" removed from her identity card. In delivering judgment in that case, the Federal Court's chief justice said the issue was related to Islamic law, and civil courts could not intervene.

Indonesia's criminal code: what is it, why does it matter, and will it be passed?

Violent protests have stymied the draft bill that contains controversial measures on sex, abortion and blasphemy

1. What is the draft criminal code?

Indonesia’s draft criminal code is a comprehensive set of proposed changes to the country’s existing penal code, which dates back to the days of Dutch colonial rule. The draft bill has been decades in the making, but was finalised by a parliamentary taskforce on 15 September this year. Before the recent widespread and vociferous uproar over the sweeping changes, parliament had scheduled to vote on it on Tuesday. It has been delayed, but the fate of the bill still hangs in the balance.

2. Why are so many people unhappy about it?

If passed, the proposed criminal code would usher in sweeping and significant changes that could threaten a wide range of civil liberties. There are more than 18 problematic articles within the bill but in protests this week students slammed the parliament for attempting to regulate their private lives and police their morality.

Among the most controversial articles are those that would outlaw extramarital sex, which activists say would criminalise homosexuality and cohabitation for unmarried couples. The bill also stipulates new laws on discussions of sex education and contraception, and includes a four-year jail term for unauthorised abortions.

But the draft code is also much more. It is feared that a vague article that refers to “living laws” could be used to legitimise hundreds of existing and discriminatory sharia laws at local level. The code also expands the existing blasphemy law, which has been used to prosecute religious minorities, and makes insulting the president, vice president and state a criminal offense, which activists fear could impact Indonesia’s hard-won press freedoms. Other articles also outlaw black magic and associating with Marxist-Leninist organisations.

3. Will tourists be affected?

Everyone in Indonesia will be affected by the law, including tourists visiting Bali. On Friday the Australian government updated its travel advice to its citizens living in, or planning to visit Indonesia, noting on its smartraveller page that: “You’re subject to local laws and penalties, including those that appear harsh by Australian standards.” The advice proceeds to outline several key changes and adds that if passed the new criminal code would not come into effect for two years.

4. What has the government/president’s response been to the crisis?

Until last week the government appeared ready to pass this controversial bill into law, but on the back of widespread outcry last Friday the president, Joko Widodo, ordered the parliament to postpone, saying more input was required.

Many students feared the parliament might still attempt to push in through in the last few days of their term, which is one of the reasons tens of thousands have protested around the country this week. Students are also angry about a new law on the country’s anti-corruption body, which will likely weaken its powers, as well as the raging forest fires in Sumatra and Kalimantan, outstanding cases of human rights abuses and militarisation in West Papua, to name a few of their concerns with the current government.

5. How likely is it that the code will be passed?

It now looks unlikely the bill will be passed in its current form by the current parliament. The head of the House of Representatives said on Tuesday the bill would be delayed to “reduce public tension and meet public aspirations”, while the head of the parliamentary commission that oversees legal matters also said the bill would be passed onto the next set of legislators. Indonesia’s security minister Wiranto further urged students to end their demonstrations yesterday, saying the bill had been postponed. The question looking forward is what the next parliament will do with the bill, and what revisions might be made to a number of problematic articles it includes.
