US District Judge Reed O'Connor today recused himself from Elon Musk's lawsuit alleging that advertisers targeted X with an illegal boycott.
O'Connor was apparently Musk's preferred judge in the lawsuit filed last week against the World Federation of Advertisers (WFA) and several large corporations. In order to land O'Connor, the Musk-owned X Corp. sued in the Wichita Falls division of the US District Court for the Northern District of Texas.
O'Connor purchased Tesla stock, a fact that generated controversy in a different X lawsuit that he is still overseeing. He also invested in Unilever, one of the defendants in X's advertising lawsuit. The Unilever investment appears to be what drove O'Connor's recusal decision.
"I hereby recuse myself from the above numbered case," O'Connor wrote in a filing today. The case was reassigned to District Judge Ed Kinkeade. Both judges were appointed by President George W. Bush. O'Connor is based in Fort Worth, while Kinkeade is based in Dallas.
A financial disclosure report for calendar year 2022 shows that O'Connor owned stock in Unilever valued at $15,000 or less. The investment generated a dividend of $1,000 or less during 2022, the filing indicates. Unilever is one of the defendants named in X's advertising lawsuit, along with Mars, Incorporated; CVS Health Corporation; and Ørsted A/S.
The 2022 disclosure also listed a purchase of Tesla stock valued between $15,001 and $50,000. "It is unclear whether O'Connor has sold his investment of up to $50,000 in Tesla stock, because the judge's disclosure form covering the 2023 calendar year is not publicly available," NPR wrote on Friday. "He has requested a filing extension, according to an official with the administrative office of US courts who was not authorized to speak on the record."
Kinkeade filed a 2023 financial disclosure report, which is much shorter than O'Connor's and lists several rental properties and bank interest.
Media Matters questioned judge’s impartiality
O'Connor's Tesla stock has been a point of contention in X's case against Media Matters for America, which O'Connor has not recused himself from. O'Connor remaining on the Media Matters case while recusing himself from the advertising case suggests that his Unilever investment is the main factor in the recusal.
Media Matters drew Musk's ire when it published research on ads being placed next to pro-Nazi content on X. Musk's lawsuit blames Media Matters for the platform's advertising losses.
Media Matters argued in a July court filing that Tesla, the Musk-led electric carmaker, should be listed by X as an "interested party" in the case. "Here, if the Court indeed owns stock in Tesla, recusal would be required under two separate provisions of the judicial recusal statue," Media Matters wrote. "By failing to disclose Tesla, however, X has deprived the Court of information it needed to make an informed recusal decision."
Media Matters said there is a public association between Musk and the Tesla brand, and that this association leads to doubts "about whether a judge with a financial interest in Musk could impartially adjudicate" the case filed by X.
"Because an investment in Tesla is, in large part, a bet on Musk's reputation and management choices—key issues in this case—ownership of Tesla stock would be disqualifying," Media Matters wrote.
X, previously named Twitter, has argued that O'Connor shouldn't have to recuse himself from the Media Matters case. Tesla does not exert any control over X, and Media Matters' argument that Tesla has an interest in the case is "tenuous and speculative," X wrote in a court filing.
O'Connor gave X a victory in April when he denied a Media Matters motion to delay discovery until its motion to dismiss is resolved. Media Matters has complained about the financial toll of the lawsuit, telling the court that "X's discovery requests are extremely broad and unduly burdensome." Media Matters also issued a statement to the press saying it needed to lay off staff because of a "legal assault on multiple fronts."
O'Connor was assigned to the Media Matters case in November 2023 after the original judge recused himself.

Breton kertoi viestissään, että Muskin päätökset voivat rikkoa säädöstä. Musk on viime aikoina muun muassa levittänyt disinformaatiota Britannian mellakoista, ja Bretonin viestin lähettämisen aikaan hänen oli pian määrä haastatella presidenttiehdokas Donald Trumpia livelähetyksessä X:ssä.

Musk vastasi viestiin törkykielisellä meemikuvalla. Hän kertoi kieli poskessa ”haluavansa vastata Bretonin viestiin näin”, mutta että ”ei koskaan voisi tehdä mitään niin törkeää ja vastuutonta”. Suoran vastauksen sijaan hän julkaisi meemin lainauksena, jolloin se levisi itse asiassa vielä laajemmalle.
Mielenkiintoista kyllä Breton lähetti viestinsä Muskille ilman lupaa Euroopan komissiolta, uutisoi muun muassa Financial Times.
FT:n mukaan Euroopan komissio oli evännyt Bretonin lupapyynnön lähettää muistutus Muskille. Komission mukaan viestin ajoitus ja sisältö eivät olleet saaneet lupaa komission puheenjohtaja Ursula von der Leyeniltä.
Tämä ei ole ensimmäinen kerta, kun EU ja Musk ovat joutuneet törmäyskurssille. Euroopan komissio linjasi heinäkuussa, että Muskin X-palvelu on rikkonut EU:n digimarkkinasäädöstä sinisten varmennusmerkkien vuoksi. Boxer Imane Khelif has filed a lawsuit over alleged cyberbullying during the Paris 2024 Olympics, which reportedly names author JK Rowling and X owner Elon Musk.
The Algerian boxer won gold in Paris, despite being disqualified from last year's World Championships by the International Boxing Association (IBA), after she was reported to have failed gender eligibility tests in 2023.
However, the International Olympic Committee strongly defended Khelif's right to compete and ruled her to be eligible.
Her lawyer Nabil Boudi told Variety on Tuesday that Musk and Rowling would be named in the lawsuit, following comments they made on social media.
Khelif's participation was widely discussed online, after Italian boxer Angela Carini abandoned her Olympic bout against her after 46 seconds.
Paris public prosecutor's office told news agency AFP on Wednesday that they had launched a cyberbullying probe, following a complaint by Khelif.
However, a prominent French legal blogger wrote on X that it is unlikely Mr Musk or Ms Rowling would face prosecution, as French penal law doesn’t apply to acts committed outside of France against foreign nationals.
But prosecutors could press charges against those who sent messages on French soil.
Khelif, along with Taiwan's Lin Yu-ting, was cleared to compete in the women's boxing in Paris, having been disqualified from last year's Women's World Championships for failing to meet eligibility criteria.
But the IOC took a different view, strongly defending the two boxers.
"This is a question of justice: women must be allowed to take part in women's competitions. And the two are women," IOC president Thomas Bach said.

On Tuesday, Elon Musk's AI company xAI announced the beta release of two new language models, Grok-2 and Grok-2 mini, available to subscribers of his social media platform X (formerly Twitter). The models are also linked to the recently released Flux image synthesis model, which allows X users to create largely uncensored photorealistic images that can be shared on the site.
"Flux, accessible through Grok, is an excellent text-to-image generator, but it is also really good at creating fake photographs of real locations and people, and sending them right to Twitter," wrote frequent AI commentator Ethan Mollick on X. "Does anyone know if they are watermarking these in any way? It would be a good idea."
In a report posted earlier today, The Verge noted that Grok's image generation capabilities appear to have minimal safeguards, allowing users to create potentially controversial content. According to their testing, Grok produced images depicting political figures in compromising situations, copyrighted characters, and scenes of violence when prompted.
The Verge found that while Grok claims to have certain limitations, such as avoiding pornographic or excessively violent content, these rules seem inconsistent in practice. Unlike other major AI image generators, Grok does not appear to refuse prompts involving real people or add identifying watermarks to its outputs.
Given what people are generating so far—including images of Donald Trump and Kamala Harris kissing or giving a thumbs-up on the way to the Twin Towers in an apparent 9/11 attack—the unrestricted outputs may not last for long. But then again, Elon Musk has made a big deal out of "freedom of speech" on his platform, so perhaps the capability will remain (until someone likely files a defamation or copyright suit).
People using Grok's image generator to shock brings up an old question in AI at this point: Should misuse of an AI image generator be the responsibility of the person who creates the prompt, the organization that created the AI model, or the platform that hosts the images? So far, there is no clear consensus, and the situation has yet to be resolved legally, although a new proposed US law called the NO FAKES act would presumably hold X liable for the creation of realistic image deepfakes.
With Grok-2, the GPT-4 ceiling still holds
Looking beyond images, in a release blog, xAI claims that Grok-2 and Grok-2 mini represent significant advancements in capabilities, with Grok-2 supposedly outperforming some leading competitors in recent benchmarks and what we call "vibemarks." It's always wise to approach those claims with a dose of skepticism, but it appears that the "GPT-4 class" of AI language models (those with similar capability to OpenAI's model) has grown larger, but the GPT-4 barrier has not yet been smashed.
"There are now five GPT-4 class models: GPT-4o, Claude 3.5, Gemini 1.5, Llama 3.1, and now Grok 2," wrote Ethan Mollick on X. "All of the labs are saying there is room left for continued giant improvements, but we haven’t seen any models truly leap above GPT-4… yet."
xAI says it recently introduced an early version of Grok-2 to the LMSYS Chatbot Arena under the name "sus-column-r," where it reportedly achieved a higher overall Elo score than models like Claude 3.5 Sonnet and GPT-4 Turbo. Chatbot Arena is a popular subjective vibemarking website for AI models, but it's been the subject of controversy recently when people disagreed with OpenAI's GPT-4o mini placing so highly in the rankings.
According to xAI, both new Grok models show improvements over predecessor Grok-1.5 in areas like graduate-level science knowledge, general knowledge, and math problem-solving in benchmarks that have similarly proved controversial. The company also highlighted Grok-2's performance on visual tasks, claiming state-of-the-art results in visual math reasoning and document-based question answering.

The models are now available to X Premium and Premium+ subscribers through an updated app interface. Unlike some of its competitors in the open weights space, xAI isn't releasing the model weights for download or independent verification. This closed approach stands in stark contrast to recent moves by Meta, which recently released its Llama 3.1 405B model for anyone to download and run locally.
xAI plans to release both models through an enterprise API later this month. The company says this API will feature multi-region deployment options and security measures like mandatory multifactor authentication. Details on pricing, usage limits, or data handling policies have not yet been announced.
Photorealistic image generation aside, perhaps Grok-2's biggest liability is its deep link to X, which gives it a tendency to pull inaccurate information from tweets. It's a bit like if you had a friend who insisted on checking the social media site before answering any of your questions, even when it wasn't particularly relevant.
As Mollick pointed out on X, this close link can be annoying: "I only have access to Grok 2 mini right now, and it seems like a solid model, but often seems ill-served by its RAG connection to Twitter," he wrote. "The model is fed results from Twitter that seem irrelevant to the prompt, and then desperately tries to connect them into something coherent."

Elon Musk said he’d eliminate bots from X. Instead, election influence campaigns are running wild

As Rwanda prepared for its national election on July 15, something strange was happening on X. Hundreds of accounts appeared to be operating in unison, posting identical or oddly similar messages in support of incumbent president Paul Kagame. A team of researchers at Clemson University started tracking the seemingly automated network and discovered more than 460 accounts involved, sharing what appeared to be AI-generated messages.
“The campaign, which exhibits several markers of coordinated inauthentic behavior, seems to be trying to affect discourse about the performance of the Kagame regime,” the researchers wrote in a paper tracing the network.
It was the kind of revelation that would normally send moderators scrambling, particularly in the weeks before a national election. But when the group reported their findings to X, nothing happened. Flagged accounts remained up, and the network continued to post.
“There’s just no effort to take down any of this.”
It was a stunning result, given the sensitivity of the country’s election and how easy it would have been to stop the network in its tracks. “It’s obvious,” researcher Morgan Wack, who led the Clemson project, told Rest of World. “If you’re paying attention at all, it’s very clear you could take down several of these accounts. There’s just no effort to take down any of this.”
Wack’s experience is part of a larger shift in moderation on X, which has opened the door to influence operations around the world. In the two years since Elon Musk took ownership of the company, its trust and safety team has been decimated — and the result has been a steady drip of networks like the one uncovered in Rwanda. Simply finding the networks is harder than ever, as researchers must do without API access and face growing legal risks after their work is published.

As X has pulled back from fighting influence operations, the stakes for democracies have only grown. Eighty-two countries will see elections at some point in 2024, including giants like India, South Africa, and Mexico, as well as smaller nations like Rwanda and Sri Lanka that are easily overlooked by moderators. X doesn’t wield influence in all of those countries, but in places where it does, the platform’s indifference to moderation has left democracy alarmingly vulnerable.
Organizations that monitor for influence operations globally have already cataloged several other ongoing campaigns, mostly focused on regions where X remains influential. In only the past six months, the Atlantic Council’s Digital Forensic Research Lab (DFRLab) has registered influence campaigns aimed at discrediting Georgian protestors and spreading confusion around the death of an Egyptian economist — both powered by inauthentic X accounts. Chinese-language spambots have continued to flood sensitive search terms on X, effectively suppressing and harassing dissident Chinese groups on the platform.
For Wack, the biggest concern is how many other campaigns are going undiscovered. With so many elections happening around the world, countries with less global attention or less well-known languages are likely to fall through the cracks.
“If you’re doing this in Tagalog in the Philippines, I’m never going to see it,” he said. “There’s not the attention that would give researchers the opportunity to even come across it.”
No social media platform is completely immune to influence campaigns, but researchers say the uptick on X is noticeably higher. According to DFRLab’s managing director, Andy Carvin, much of the change can be traced to specific decisions the platform made under Musk’s leadership, particularly laying off 80% of the platform’s trust and safety team. “If you look at X circa 2024 and compare it to where it was during the U.S. election in 2020, the trust and safety team that was once there is gone,” Carvin told Rest of World.
Another change was the rebuilding of X’s verification system, initially intended to highlight verified, notable accounts with a “blue check” badge. Musk revamped the system, making the badges available to anyone paying a subscription fee — claiming that the need to pay a fee served as verification that the user was a human, not a bot. Instead, the easy availability of the badge has made a verified status on the platform far more accessible to coordinated campaigns.
“It is shocking how easy it has been to find accounts that appear to be bots spreading division around the U.K. vote.”
The result has been a flood of new campaigns targeting elections. Starting in May, researchers at the human rights group Global Witness monitored election hashtags leading up to the U.K. election on July 4. More than 610,000 of the posts were from a network of “bot-like accounts” that promoted conspiracy theories, xenophobia, and other divisive topics.
Like the Clemson researchers, Global Witness informed X of their findings, but received only an automated reply. The accounts remain live on the platform, where they have shifted to spreading misinformation about the U.S. election or anti-migrant protests in Ireland.
“It is shocking how easy it has been to find accounts that appear to be bots spreading division around the U.K. vote, and then to watch them jump straight into political discussions in the U.S.,” Ellen Judson, the group’s senior investigator of digital threats, told Rest of World.
When Musk first moved to acquire X, he emphasized the dire effects of bot accounts, and pledged to remove them as one of his first acts as owner. He appeared to be following through on that promise in April when he announced a “system purge of bots & trolls.” (Later that day, the platform’s official safety account described the purge as “a significant, proactive initiative to eliminate accounts that violate our Rules against platform manipulation and spam.”) But the fruits of those efforts have been slow to ripen, and both spam and sock-puppet accounts remain common on the platform.

When researchers have succeeded in removing bot networks, it has largely been the result of legal force. In July, the U.S. Department of Justice took action against 968 X accounts alleged to be part of a Russian disinformation campaign. The platform voluntarily suspended the accounts, but only after a court-ordered search and more than a month of filings and procedure.
Renee DiResta, former research manager at the Stanford Internet Observatory, told Rest of World many of the informal mechanisms for taking down influence campaigns are now closed off.

“In prior times, Twitter’s integrity teams would engage with people outside of the company, and there would be more proactive ways of doing investigations and responding,” DiResta said. “I don’t think the platform has very much interest in engaging in that way now.”
Researchers are also facing growing impediments to finding influence operations in the first place. The easiest way to access X posts at scale is through the platform’s API, making it vital for researchers and academics. But while API access was once available for free to academics and research groups, it’s now metered according to access tiers that can cost as much as $42,000 a month.
Under Musk, the company has also sued research groups for reporting on activity that reflects poorly on the platform, launching civil cases against the Center for Countering Digital Hate and Media Matters. The former case has been dismissed, but the latter is scheduled for trial in April 2025. The lawsuits have had a chilling effect on the community at large, making many groups reluctant to conduct research on the platform.
But while there’s less interest in tracking down the operations, there’s no indication that the operations themselves have slowed down — a fact with chilling implications for the remaining elections of 2024. Dozens of elections will stir up dozens of different national feuds, and wherever platforms fail to police inauthentic activity, influence operations will take advantage.
“There have always been efforts to interfere in the politics of their geopolitical rivals,” DiResta said. “We saw this in every prior media ecosystem going back centuries. It’s done on social media now because people are on social media. So of course they’re going to continue to do it. And why wouldn’t they? There’s no downside.”
